1. Acceptance of Terms

By accessing and using the services of Echo Beach Construction ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Services

Echo Beach Construction provides professional construction and renovation services including but not limited to:

• New construction projects
• Home renovations and remodeling
• Extensions and additions
• Commercial construction
• Design and planning services
• Emergency repair services

3. Quotes and Estimates

All quotes and estimates provided are:

• Valid for 30 days from the date of issue unless otherwise specified
• Subject to site inspection and final measurements
• Based on information provided by the client
• Exclude VAT unless specifically stated
• Subject to availability of materials and labor

4. Contract Terms

Contract Formation

A contract is formed when both parties sign a written agreement specifying the scope of work, timeline, and payment terms.

Changes to Scope

Any changes to the agreed scope of work must be documented in writing and signed by both parties. Additional costs may apply for scope changes.

Timeline

Project timelines are estimates and may be affected by weather conditions, material availability, permit delays, and other factors beyond our control.

5. Payment Terms

• Payment schedules will be specified in individual contracts
• Payments are typically required in stages based on project milestones
• Final payment is due upon completion and client acceptance
• Late payments may incur interest charges
• We reserve the right to suspend work for non-payment

6. Materials and Labor

Materials

Unless otherwise specified, we will supply all materials. Material specifications and brands may be subject to availability and may be substituted with equivalent alternatives.

Client-Supplied Materials

If clients supply materials, they are responsible for ensuring correct specifications, quantities, and timely delivery. We are not liable for delays or defects related to client-supplied materials.

7. Permits and Approvals

Unless otherwise agreed in writing, obtaining necessary permits and approvals is the client's responsibility. We can assist with permit applications for an additional fee.

8. Warranties

We provide the following warranties:

• Workmanship warranty: 12 months from completion
• Material warranties as provided by manufacturers
• Structural work warranty: 2 years from completion

Warranties do not cover normal wear and tear, damage from misuse, or modifications by others.

9. Limitations of Liability

Our liability is limited to the contract value of the specific project. We are not liable for:

• Consequential or indirect damages
• Loss of use or business interruption
• Damages exceeding the contract value
• Delays due to circumstances beyond our control

10. Insurance

We maintain appropriate public liability and employer's liability insurance. Proof of insurance is available upon request. Clients are responsible for ensuring their own property insurance covers construction work.

11. Health and Safety

We are committed to maintaining high health and safety standards. Clients must:

• Provide safe access to work areas
• Inform us of any known hazards
• Comply with our safety requirements
• Ensure non-project personnel stay away from work areas

12. Cancellation Policy

Cancellation terms vary by project stage:

• Before work begins: 48 hours notice required
• After work begins: Client liable for work completed and materials ordered
• We reserve the right to cancel for non-payment or unsafe conditions

13. Dispute Resolution

Any disputes arising from our services shall be resolved through:

1. Direct negotiation between parties
2. Mediation through an agreed mediator
3. Arbitration or legal proceedings in UK courts

14. Force Majeure

We are not liable for delays or failures to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor strikes, or material shortages.

15. Privacy and Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to such processing.

16. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any legal proceedings shall be subject to the exclusive jurisdiction of the English courts.

17. Modifications

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the effective date. Continued use of our services after changes constitutes acceptance of new terms.
